Terms of Service

Welcome to Roam Dumpster Rentals (“we,” “us,” or “our”). By accessing or using our services (the “Service”), including renting a dumpster, receiving text or email updates, and using any related tools or resources, you (“you” or “the Customer”) agree to abide by the following Terms of Service (“Terms”). Please read these Terms carefully, as they constitute a legally binding agreement between you and Roam Dumpster Rentals. If you do not agree with any part of these Terms, you must discontinue using our services.

1. DEFINITIONS

1.1 “Lessor” refers to Roam Dumpster Rentals, an entity of ROAM Recycling Group LLC.
1.2 “Lessee” or “Customer” refers to any individual or entity renting a dumpster and/or using our services.
1.3 “Dumpster” refers to the roll-off container provided by Lessor under the terms of this agreement.
1.4 “Agreement” refers to these Terms of Service, any Rental Agreement signed by the Customer, and any other policies referenced herein.

2. RENTAL PERIOD & RATES

2.1 Initial Rental Period

• Each dumpster rental covers the first three (3) days for a set price based on the size you select.
• After three (3) days, a daily fee of $5.00 applies unless otherwise specified.
• The maximum rental period is thirty (30) days unless previously agreed upon.

2.2 Payment & Fees

• Rental fees are due as specified in your invoice or during the online checkout process.
• Additional charges (e.g., weight overages, disposal of prohibited items, late fees) may be billed separately.
• If an invoice remains unpaid after two (2) weeks from receipt, a late charge equal to ten percent (10%) of the outstanding balance will apply.

2.3 Extended Rental

• If you fail to contact Lessor to remove the dumpster by the end of the 30-day period, Lessor may remove it at their discretion and charge you for up to 30 days of use plus any applicable fees.

3. RESTRICTED ITEMS & USAGE

3.1 Prohibited Materials

• Customer agrees not to deposit any materials forbidden by local, state, or federal law, including but not limited to hazardous waste, liquids, batteries, tires, and chemicals.
• A full list of prohibited items can be found on our website or provided upon request.

3.2 Overfilling

• Overfilling beyond the top rail is strictly prohibited. Items must not stick out above or hang over the sides of the dumpster.
• Customer is responsible for any cleanup or damages resulting from overfilled dumpsters.

3.3 Hazardous Materials

• Any fines, penalties, or legal fees incurred by Lessor due to hazardous or otherwise prohibited materials placed by the Customer in the dumpster shall be billed to the Customer.

4. DELIVERY & PICKUP

4.1 Delivery Arrangements

• We will deliver the dumpster to the location you specify. You are responsible for providing accurate placement instructions and ensuring the drop-off area is clear and accessible.

4.2 Pickup Scheduling

• Once you are finished with the dumpster, you must contact us to schedule pickup.
• If we do not receive notice from you by the end of your rental term (or day 30 at the latest), we may remove the dumpster at our discretion.

4.3 Driveway & Property Protection

• We take reasonable care when delivering and removing dumpsters. However, you acknowledge there may be minor damage to driveways, lawns, or surfaces. You agree that Lessor is not liable for normal wear or minor damage resulting from drop-off, use, or pickup.

5. WEIGHT LIMITS & OVERAGES

5.1 Tonnage Allowance

• Each dumpster includes a set tonnage allowance. Once the dumpster is weighed at the disposal facility, any excess weight will be charged at the rate of $65.00 per ton (or as specified in your Rental Agreement).

5.2 Accurate Weight

• The weight measurement provided by the disposal facility is final. If you dispute this measurement, you must provide documentation or arrange for an alternate weighing.

6. TEXT & EMAIL COMMUNICATION (A2P COMPLIANCE)

6.1 Consent to Communicate

• By using our Service, you agree to receive automated text messages (SMS) and/or email updates regarding delivery times, pickup schedules, and promotional offers, consistent with A2P (Application-to-Person) messaging guidelines.

6.2 Opt-Out

• You may opt out of automated text messaging at any time by replying “STOP” or using the unsubscribe link in emails. Please note that opting out of certain messages may limit our ability to communicate critical information about your rental.

6.3 Privacy

• We handle your contact information according to our Privacy Policy. We do not sell or share your phone number or email with third parties for marketing purposes without your explicit consent.

7. BREACH & TERMINATION

7.1 Breach of Agreement

• If you fail to comply with these Terms, including nonpayment or improper disposal of prohibited items, Lessor reserves the right to terminate your rental immediately and retrieve the dumpster at your expense.

7.2 Legal Enforcement

• Should Lessor require legal services to enforce any part of these Terms or the Rental Agreement, Customer agrees to pay all reasonable attorney fees, court costs, and related expenses incurred by Lessor.

8. LIABILITY & INDEMNIFICATION

8.1 Limitation of Liability

• To the maximum extent allowed by law, Lessor is not liable for any damage or injury arising from the use of the dumpster, including accidental damage to driveways, personal property, or landscaping.

8.2 Indemnification

• You agree to indemnify, defend, and hold Lessor harmless against all claims, liabilities, damages, or expenses resulting from your actions, misuse of the dumpster, or violation of these Terms.

9. DISCLAIMER OF WARRANTIES

9.1 As-Is Service

• Lessor provides dumpsters and related services “as is” and “as available” without any express or implied warranty of merchantability or fitness for a particular purpose.

10. GOVERNING LAW & DISPUTE RESOLUTION

10.1 Governing Law

• These Terms are governed by the laws of the state in which the Lessor operates, without regard to conflict of law principles.

10.2 Venue

• Any legal dispute arising under or in connection with these Terms will be brought exclusively in the state or federal courts located in Lessor’s primary business location, unless both parties agree to an alternative dispute resolution.

11. MODIFICATIONS & UPDATES

11.1 Right to Modify

• Lessor reserves the right to update or modify these Terms at any time. Changes become effective immediately upon posting the revised Terms on our website or otherwise providing notice to you.

11.2 Continued Use

• By continuing to use the Service after changes are posted, you agree to the new Terms. If you do not agree, you must cease using the Service immediately.

12. ENTIRE AGREEMENT

12.1 Complete Understanding

• These Terms, along with the Rental Agreement and any additional policies referenced, constitute the entire agreement between Lessor and Lessee. No oral statements or promises will override these written Terms.
